General: The following are the rules or "Terms" that govern use of the Ticket King Web site ("Site"). By using or visiting the Site, you expressly agree to be bound by these Terms and to follow these Terms and all applicable laws and regulations governing the Site. Ticket King reserves the right to change these Terms at any time, effective immediately upon posting on the Site. If you violate these Terms of Use, Ticket King may terminate your use of the Site, bar you from future use of the Site, cancel your ticket order, and/or take appropriate legal action against you. TicketKingOnline.com is a private ticket broker and is not affiliated with any venue, box office, TicketMaster, Tickets.com, or any of their respective affiliates. TICKET KING DOES NOT SELL TICKETS AT FACE VALUE. OUR TICKETS ARE PREMIUM SEATING FOR SOLD OUT AND HARD TO FIND EVENTS. OUR SELLING PRICE IS DETERMINED BY OUR COST FOR OBTAINING THESE TICKETS. Prices stated on the Site do not include any state or other local taxes that may apply to User's order. All prices are in United States Dollars (USD) unless otherwise specifically stated.

Orders: All sales are final. Since tickets are one-of-a-kind items and not replaceable, there are no refunds, exchanges or cancellations. If an event is postponed, tickets will be honored for the rescheduled date. New tickets will not need to be issue. If an event is cancelled without a rescheduled date, you will have the option of receiving a full refund of the face value of the tickets or a full in-store credit for the amount you paid for the tickets less shipping and handling charges. In this case tickets are required to be returned to Ticket King within 14 days of the canceled show announcement. Any shipping and handling charges are not refundable. Ticket King will not issue exchanges or refunds after a purchase has been made or for lost, stolen, damaged or destroyed tickets. When you receive your tickets, please keep them in a safe place. Please note that direct sunlight or heat can sometimes damage tickets.

Occasionally, the tickets you order may no longer be available at the time your order is received. If equivalent or better seat locations are available at the same price, and you have chosen to be automatically upgraded, we will fill your order with the alternative seat locations. If you are automatically upgraded, your credit card will be charged at the time your order is received and you will be contacted for notification of your new seat locations. If you have not chosen to be automatically upgraded, a Ticket King representative will contact you to discuss alternative seat locations and your credit card will not be charged until we have received permission from you to fill your order with alternative seat locations.

All orders are shipped to the billing address of your credit card (no exceptions) via your chosen shipping method. Most orders are processed the same business day in which they are received. Orders placed after hours will be processed on the next business day. For certain events, tickets may not be available for immediate shipment. In this case a Ticket King representative will contact you with notification of approximately when your tickets will be shipped. All shipments required a signature at the point of delivery.

Pricing and Availability : Since tickets are bought and sold on an open market prices and availability are subject to change at anytime. If your first choice of seats is not available, Ticket King reserves the right to offer the choice to downgrade or upgrade the order to the next available category of seats with an appropriate price abatement or increase respectively. In this event, Ticket King will contact you either via phone or e-mail for your consent prior to order completion.

Purchase Policy : When placing your order please select a delivery method that allows enough time for you to receive you order before the event occurs. Ticket King is not responsible for deliveries that take longer than the estimated times. If you have not received your tickets within 48 hours prior to the event you have an obligation to notify Ticket King. All sales are final. We are not responsible for lost or stolen tickets, change of venue, date, time, or rainout. No customer initiated refunds, cancellations, or exchanges allowed with the exception of a canceled event. If a concert, sporting, or theater event is cancelled, only the face value will be refunded less a 10 dollar service charge per ticket. Tickets must be returned to our offices in order for you to receive a refund. Tickets should be returned via traceable means (e.g. certified mail, FedEx, UPS, etc.), and all requests for refunds must be submitted in writing within 5 business days of the cancelled event. By entering payment information and submitting your order you understand that this will serve as an authorized signature.

Order Acceptance Policy : Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, it only reflects our acknowledgment of your request for tickets. Ticket King, Inc. reserves the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order.

International Orders : All prices, as displayed, represent United States currency. Shipping rates vary as listed on site. International orders may take longer to process and ship. An e-mail address is required for all international orders.

Permitted Use : You agree that you are only authorized to visit, view and to retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review event and promotional information, for personal use, or to purchase tickets or merchandise for your personal use, unless otherwise specifically authorized by Ticket King to do so. The content and software on this Site is the property of Ticket King and/or its suppliers and is protected by U.S. and international copyright laws. By ordering from our site you agree to accept emails directly related to the product you ordered. If you no longer wish to receive emails from our company, you may unsubscribe at any time. We do not sell or rent or share emails with any other entity.

Links : The Site may automatically produce search results that reference or link to third party sites throughout the World Wide Web. Ticket King has no control over these sites or the content within them. Ticket King cannot guarantee, represent or warrant that the content contained in the sites is accurate, legal and/or inoffensive. Ticket King does not endorse the content of any third party site, nor do we warrant that they will not contain viruses or otherwise impact your computer. By using the Site to search for or link to another site, you agree and understand that you may not make any claim against Ticket King for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or to link to another site. If you have a problem with a link from the Site, please notify us at cortney@ticketking.net and we will investigate your claim and take any actions we deem appropriate in our sole discretion.

Prohibited Content : The following is a partial list of the kind of Content that is illegal or prohibited on the Site. It includes Content that:

• Is patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
• Could be harmful to minors;
• Harasses or advocates harassment of another person;
• Involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";
• Promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous
• Promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
• Contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
• Displays pornographic or sexually explicit material of any kind;
• Provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;

Violation of the Terms You understand and agree that in Ticket Kingâ??s sole discretion, and without prior notice, Ticket King may terminate your access to the Site, cancel your ticket order or exercise any other remedy available and remove any unauthorized User Content, if Ticket King believes that the User Content you provided has violated or is inconsistent with these Terms of Use violated the rights of Ticket King, another User or the law. You agree that monetary damages may not provide a sufficient remedy to Ticket King for violations of these terms and conditions and you consent to injunctive or other equitable relief for such violations. Ticket King may release user information about you if required by law or subpoena, or if the information is necessary or appropriate to release to address an unlawful or harmful activity. Ticket King is not required to provide any refund to you if you are terminated as a User because you have violated these Terms of Use.

Copyright Policy We will terminate the privileges of any user who uses this Site to unlawfully transmit copyrighted material without a license express consent, valid defense or fair use exemption to do so. In particular, users who submit Content to this Site, whether articles, images, stories, software or other copyrightable material must ensure that the Content they upload does not infringe the copyrights or other rights of third parties (such as privacy or publicity rights). After proper notification by the copyright holder or it agent to us, and confirmation through court order or admission by the user that they have used this Site as an instrument of unlawful infringement, we will terminate the infringing users' rights to use and/or access to this Site. We may, also in our sole discretion, decide to terminate a user's rights to use or access to the Site prior to that time if we believe that the alleged infringement has occurred.

Disclaimers Ticket King does not promise that the Site will be error-free, uninterrupted, nor that it will provide specific results from use of the Site or any Content, search or link on it. The Site and its Content are delivered on an "as-is" and "as-available" basis. Ticket King cannot ensure that files you download from the Site will be free of viruses or contamination or destructive features. Ticket King disclaims all warranties, express or implied, including also any implied warranties of merchantability and fitness for a particular purpose. Ticket King will not be liable for any damages of any kind arising from the use of this Site, including without limitation, direct, indirect, incidental, punitive and consequential damages.

Typographical Errors In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Ticket King shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Ticket King shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Ticket King shall immediately issue a credit to your credit card account in the amount of the charge.

Ticket King makes no guarantee of any specific result from use of this Site or use of the Ticket King service.

Ticket King disclaims any and all liability for the acts, omissions and conduct of any third party users, Ticket King users, advertisers and/or sponsors on the Site, in connection with the Ticket King service or otherwise related to your use of the Site and/or the Ticket King service. Ticket King is not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or referenced on the Site. Ticket King may investigate the claim and take appropriate action, in its sole discretion.

Limitation of Liability as to Products Sold YOU EXPRESSLY UNDERSTAND AND AGREE THAT TICKET KING SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTAIL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSS, EVEN IF TICKET KING HAS BEEN ADVISED OF THE POSSIBILTY OF SUCH DAMGES.

Limitation on Liability Except in jurisdictions where such provisions are restricted, in no event will Ticket King be liable to you for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits, even if Ticket King has been advised of the possibility of such damages.

Disputes If there is any dispute about or involving the Site, by using the Site, you agree that the dispute will be governed by the laws of the State of Minnesota without regard to its conflict of law provisions. You agree to personal jurisdiction by venue in the state and federal courts of the State of Minnesota, City of Minneapolis

Indemnity You agree to indemnify and hold Ticket King, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site.

Amusement Sales Taxes Events taking place within the Minneapolis or St. Paul city limits may require the addition of sales tax to the total order amount. Orders meeting the requirements set forth by Minneapolis and St. Paul city laws will be charged a variable amusement tax up to 10.15% applied to the difference of the retail value and the face value.

General Shipping Info Federal Express (FedEx) shipping is utilized for any and all shipments. Furthermore a signature is required upon delivery for every order. Please note that FedEx cannot and will NOT deliver to any P.O. Box so therefore a physical street address must be provided or the order cannot be processed.

The majority of orders for regular season sporting events, concerts, and theatre are shipped within 24 to 48 hours after confirmation but not necessarily if the order was placed on a weekend. Certain orders for events are not delivered until very close to the date the event takes place. In any case, we might contact the customer to confirm the shipping address prior to shipment.

International Orders International shipments can be processed but sometimes there are exceptions. In the event we are unable to ship to your location, we will contact you through e-mail or by phone. The prices to ship internationally are listed below. Please note that prices are subject to change and are priced in US Dollars:

Delivery of Tickets All times for delivery are dependent on the availability in your delivery area. Once you sign for your order from FedEx, you (customer) have 48 hours to contact us about any mistakes, discrepancies, or questions about tickets and/or seating locations. These discrepancies may include: tickets that are in the wrong section or row, tickets for the wrong event/date and/or the tickets are damaged. In such instances like these, every effort possible will be made to rectify the situation. However, if your original order is no longer available, and replacement tickets are no longer an option, the order will be cancelled. In order for the refund to be processed, the tickets must be shipped back to Ticket King to receive a refund. Please note that there are no cancellations, refunds or exchanges on orders with no inconsistencies.

Due to time constraints involved Ticket King has satisfied its contractual obligations when the order has been shipped to the address provided by the customer. In no circumstance whatsoever is Ticket King responsible for any typos or incorrect addresses provided by the customer or for returned orders when the customer was not available to sign for the package at the time of delivery at discretion of FedEx. In most circumstances, Ticket King will retain packages returned by FedEx for later re-delivery to the customer at our discretion. Ticket King is not responsible in any circumstance for any delivery problems/delays after the order has been shipped.

With no exceptions, the customer has an obligation/duty to notify Ticket King prior to the order being shipped if there are any changes to the shipping address.

If the shipment needs to be redirected while it is transit for delivery, or if a shipping method is upgraded due to a delivery method being selected with insufficient time for delivery before the event date, the customer is obligated to pay any and all address correction fees charged by FedEx. When the shipment is shipped directly to a FedEx location, a photo ID is required for pick-up. In this circumstance, this must be approved b a Ticket King sales representative.
